Terms of Service

1. Acceptance

By creating an account or using Monica you agree to these Terms. If you do not agree, do not use the platform.

2. The Service

Monica provides a job board, resume builder, cover letter builder, ATS resume scorer, job tracker, and related tools. Features are subject to change. We reserve the right to discontinue any feature with reasonable notice.

3. Accounts

• You must provide accurate information at registration.
• One account per person. Shared or automated accounts are not permitted.
• You are responsible for maintaining the confidentiality of your credentials.
• You must be at least 16 years old to use the platform.

4. Candidates

• Resume and application data you enter belongs to you.
• By submitting an application, you grant the relevant employer access to your resume and contact details for recruitment purposes.
• You are responsible for the accuracy of your resume and application materials.

5. Employers

• Job listings must be for genuine, existing roles.
• Listings must not discriminate on grounds prohibited by applicable law.
• You may not use candidate data for purposes other than evaluating applications for the listed role.
• Misleading or fraudulent listings will be removed and may result in account termination.

6. Free Tier Limits

• ATS Resume Scorer: 3 scans per calendar month on the free tier.
• Cover Letter Builder: 3 cover letters per calendar month on the free tier.
• These limits reset at the start of each calendar month.

7. Prohibited Use

You may not:

• Use the platform to scrape, harvest, or collect data from other users.
• Post spam, malware, or malicious content.
• Attempt to gain unauthorised access to any part of the platform.
• Impersonate any person or organisation.
• Use the platform for any unlawful purpose.

8. Intellectual Property

The Monica name, logo, and platform code are owned by Monica. Your resume content, cover letters, and profile data remain yours. You grant us a limited licence to store and display your content to provide the service.

9. Payments

• Paid features are billed via Stripe.
• Subscription fees are charged at the start of each billing period.
• Refunds are not issued for partial periods or features already used.
• We reserve the right to change pricing with 30 days notice.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms without prior notice. On termination, your data is deleted in accordance with our Privacy Policy.

11. Disclaimers

The platform is provided as-is. We do not guarantee job placement, interview success, or any particular outcome from using the service. ATS scores are indicative and not a guarantee of any employer's actual ATS system.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Monica is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of Kenya. Disputes will be resolved in the courts of Kenya. If you are located in the EU, you retain the right to bring a claim before your local courts or competent supervisory authority.

14. Changes

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be communicated by email.
